A prenuptial agreement (prenup) is a legal agreement a couple enters into before marriage or civil partnership, which sets out how their assets, income and debts will be treated, shared or divided if the marriage ends. If you are not starting out with “significant” assets, it can still bring certainty, prevent conflict and protect any inheritances, business interests or property you acquire before marriage.
In England and Wales, they are not automatically legally binding, but are increasingly respected by the courts, particularly in the wake of the landmark Radmacher v Granatino case in 2010. A prenup will be taken into account if it was entered into freely, with full understanding and financial disclosure, and if the terms are fair.
Prenups are intended to be pre-marriage agreements, but spouses can create a postnuptial agreement to modify terms after marriage. Like prenups, postnuptial agreements require legal advice, full disclosure, and fairness to be considered by the court.
